Photography Session Agreement

This agreement is entered into between Adri Krige Photography (“the Photographer”) and the person named and signing below (“the Client”). It comes into effect on the date of signature, together with the written booking confirmation and quotation sent to the Client by email.
1. The session
The date, time, location, duration and fee for the session are those set out in the written booking confirmation and quotation issued to the Client by the Photographer. That confirmation forms part of this agreement.
2. Booking fee and payment
A non-refundable booking fee of 50% of the session fee is payable to secure the date. No date is held or reserved until the booking fee reflects in the Photographer’s account. The balance is payable no later than 48 hours before the session, unless otherwise agreed in writing. Products, prints and albums are paid for in full before they are ordered.
3. Rescheduling
The Client may reschedule once at no charge, provided the Photographer receives at least seven (7) days written notice. The booking fee transfers to the new date, which must fall within three (3) months of the original booking. Rescheduling with less than seven days’ notice, or a second reschedule, requires a new booking fee.
4. Weather, light and the wellbeing of animals
Outdoor and equine sessions depend on weather, light and the state of the ground. The Photographer may postpone a session where conditions would compromise safety, welfare or the quality of the work, at no cost to the Client, and will offer the next suitable date. The wellbeing of every animal present takes precedence over any photograph. No horse will be pushed beyond what it is comfortable with.
5. Cancellation
Should the Client cancel, the booking fee is not refundable. Where a session is cancelled within 48 hours of the agreed start time, or where the Client does not arrive, the full session fee remains payable. Should the Photographer be unable to attend through illness, accident or circumstances beyond her control, she will offer an alternative date or a full refund of all monies paid, including the booking fee. The Photographer’s liability in such an event is limited to the total amount paid by the Client.
6. Travel
Sessions within 50 km of St Francis Bay carry no travel charge. Beyond that, travel is charged at R6,50 per kilometre from St Francis Bay and back. Where an equine session requires an overnight stay, reasonable accommodation costs are quoted and agreed in writing before the booking is confirmed.
7. Delivery of your photographs
A private online gallery of edited photographs is delivered within sixty (60) days of the session, or of final image selection where applicable. Peak periods may extend this, and the Client will be told in good time. The gallery remains available for thirty (30) days, after which archiving is not guaranteed. The Client is responsible for downloading and safely backing up their files. The Photographer keeps no permanent archive and cannot guarantee that files can be recovered after this period.
8. The work itself
Photographs are delivered in the Photographer’s established style, which the Client has seen and accepts as the reason for this booking. Selection, colour, tone and finishing are the Photographer’s artistic judgement. Standard editing — light, colour, minor distractions — is included. Substantial retouching, compositing or the removal of permanent features is quoted separately. Unedited, raw or rejected files are not supplied under any circumstances.
9. Copyright and how you may use the images
Copyright in all photographs remains with Adri Krige Photography at all times, in terms of the Copyright Act 98 of 1978. On full payment, the Client receives a personal-use licence to print the images, share them privately, display them at home and gift them to family and friends.
The licence does not extend to commercial use, resale, licensing to third parties, stock libraries, advertising, sponsorship or brand content, nor to entering the photographs into competitions as the Client’s own work. Commercial, stud and sales licences are available and are quoted separately. Written permission is required in each case.
10. Sharing online
Images shared publicly must be shared as delivered. Please do not apply filters, crop, re-edit or remove any watermark. A credit to Adri Krige Photography is warmly appreciated and never required.
11. Portfolio and marketing
Unless the Client indicates otherwise below, the Photographer may use photographs from the session on her website, social media, printed portfolio, exhibitions, competitions, editorial features and marketing material. This is entirely optional for the Client and declining it changes nothing about the session, the price or the care taken.
12. Safety, horses and responsibility
The Client warrants that any horse or animal present is suitable to be handled and photographed, and that a competent handler will be present throughout. The Client remains responsible for the behaviour of their animals and for the safety of the property, yard or venue used.
The Client attends the session, and permits their family, guests and animals to attend, at their own risk. The Client indemnifies the Photographer against any claim for injury, loss or damage arising from the conduct of an animal, from the condition of the property, or from the actions of the Client or their guests, save where such loss is caused by the Photographer’s own gross negligence or wilful misconduct. Equally, the Photographer carries her own insurance and takes full care with equipment and conduct on site.
13. Children
Where a person under eighteen is photographed, this agreement must be signed by a parent or legal guardian, who confirms they have the authority to give consent on that child’s behalf. A parent or guardian remains responsible for supervising children throughout the session.
14. Prints and products
Prints, albums and framed artwork are produced through the Photographer’s chosen professional laboratories and are colour-managed to her standard. Where the Client chooses to print elsewhere, the Photographer cannot take responsibility for colour, cropping or quality, and no reprint or refund can be offered on that basis.
15. Loss or technical failure
The Photographer works with professional equipment, dual memory cards and backed-up storage. In the unlikely event that images are lost or corrupted through equipment failure, and where the session cannot reasonably be repeated, the Photographer’s liability is limited to a full refund of all amounts paid by the Client. No liability is accepted for indirect or consequential loss.
16. Circumstances beyond our control
Neither party is liable for failure to perform because of events genuinely beyond their control, including severe weather, illness, accident, death, load shedding at scale, civil unrest, road closures or government restriction. In such an event the parties will agree a new date in good faith.
17. Your personal information
Information provided in this form is used solely to plan, deliver and administer the session, in line with the Protection of Personal Information Act 4 of 2013. It is never sold or shared for marketing by anyone else. The Client may ask for a copy of their information, or ask for it to be corrected or deleted, by writing to info@adrikrigephotography.co.za.
18. Conduct
Both parties undertake to treat one another with courtesy and respect. The Photographer reserves the right to end a session, without refund, in the event of abusive behaviour, intoxication, or conduct that endangers any person or animal present.
19. General
This agreement, together with the written booking confirmation and quotation, is the whole agreement between the parties. Any change must be agreed in writing. It is governed by the laws of the Republic of South Africa, and the parties consent to the jurisdiction of the Magistrate’s Court, Eastern Cape. If any clause is found unenforceable, the rest remains in force.
20. Signature
By typing their full name below and confirming agreement, the Client signs this document electronically. The parties agree that this constitutes a valid electronic signature in terms of the Electronic Communications and Transactions Act 25 of 2002, and has the same effect as a signature in ink.
